Illinois – Cannabis Legal Overview

In 2019, Illinois became the 11th state to legalize cannabis for adult use, and the first in the country to adopt a regulatory system for cannabis cultivation, testing, and sales through a state legislature.

Sales began on January 1, 2020, and despite shortages of cannabis and only handful of stores open, state regulators estimated close to $11 million in sales the first week.

Legalization in Illinois is also historic because of the measures the state took to look at the need for expungement of individuals convicted of marijuana crime.. It is estimated that around 740,000 marijuana cases will be eligible for automatic expungement, and the approach provides benefits for those who were impacted by the war on cannabis. Those who were arrested, jailed, charged, or convicted of a marijuana offense qualify for additional points on business applications and access to financial resources to start a business in the emerging cannabis industry. Additional tax revenues were created to fund new social programs.

As required by the Compassionate Use of Medical Cannabis Act, the Illinois Department of Public Health (IDPH) is providing notice to the public of the annual period for submitting petitions for the addition of debilitating medical conditions to the list prescribed by Section 10 of the Act.  Beginning at 12:01AM December 1, 2021 and ending at 11:59PM December 31, 2021, IDPH will accept petitions on forms and in a manner prescribed by IDPH.  The forms and instructions are available here.
