Does your state have legal cannabis?

No.  As of this writing, October 25, 2022, Kentucky is one of only 13 states that lacks a comprehensive medical cannabis law and one of only 19 states that still punishes simple possession of cannabis with jail time. In March 2022, MPP released a report highlighting the 19 states — including Kentucky — that have yet to decriminalize cannabis and the negative consequences of this inaction. Despite a majority of Kentuckians supporting full legalization, legislators were unsuccessful at even reducing criminal penalties to a civil fine. Under current law, a first offense for possession of up to eight ounces of cannabis carries a maximum penalty of 45 days’ imprisonment and up to a $250 fine.

On March 17, 2022, the Kentucky House of Representatives voted 59-34 to pass a medical cannabis bill, HB 136. This was the second time the full House ever voted on the issue, and the second time that it passed. But unfortunately, Senate leadership refused to assign the bill to a committee, effectively ending the bill for the year.

A disappointment for patients, who have been working for many years to convince the legislature to pass medical cannabis. A February 2020 Kentucky Health Issues Poll found that 90% of Kentuckians support medical cannabis., providing more of a conundrum for Kentuckians supporting medical marijuana legalization. Although Rep. Jason Nemes, Sen. Stephen West, and other compassionate legislators have introduced medical cannabis legislation, none of the bills have advanced in the Senate.

There are initiatives underway, although with lots of roadblocks to pass the law in Kentucky, and at Medical Marijuana 411 we believe in the right to education. Kentucky–Marijuana Legal Overview

Possession of CBD by persons who are acting outside of a state-sponsored clinical protocol is not permitted under the law. It is confusing because there are no dispensaries in Kentucky and it is unclear what a “state-sponsored clinical protocol” is and how to obtain product if you have Intractable Epilespy, the only qualifying condition.

“Polling suggests 90% of Kentucky adults support legalizing medical cannabis. Our team traveled the state to talk directly to Kentuckians, and they found our people do indeed overwhelmingly support it,” Beshear said in a statement from the governor’s office on October 4, 2022 . “I appreciate the work of those who participated, and I am taking this information into consideration as I analyze what steps I can take to legalize medical cannabis for those suffering from chronic, debilitating medical conditions.”
